With the recent passing of Proposition 64, among other laws, the entire landscape of California marijuana law has changed, including, as of January 1, 2018, the right of Californians, with exceptions, to legally purchase marijuana for recreational purposes.
While the new California marijuana laws are on the books, law enforcement’s interpretation and enforcement of these laws, both on the local, state and federal levels is still unclear and concerning. Federal law, for example. still criminalizes marijuana, and the U.S. Attorney General has already indicated that the Federal Government intends to prosecute individuals that would otherwise be safe from prosecution under California state law.
